1. Acceptance of terms
By accessing or using TryTheClothes (the “Service”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the Service.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. By using it, you represent that you meet this requirement and have the legal capacity to enter into these terms.
3. Your account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You agree to provide accurate information and to keep it up to date.
- Notify us immediately of any unauthorised use of your account.
- One person or entity may not maintain multiple accounts to abuse free credits or promotions.
4. Credits & payments
- The Service uses credits (“try-ons”). One credit generally produces one try-on result.
- New users may receive a limited number of free credits. Additional credits can be purchased in packs.
- Prices are shown at checkout and may change over time. Applicable taxes may apply.
- Payments are processed securely by Razorpay. By purchasing, you agree to their terms as well.
- Purchased credits do not expire but are non-transferable and have no cash value.
- Refunds are handled under our Refund Policy.
5. Your content & photos
- You retain ownership of the photos and images you upload (“User Content”).
- You grant us a limited licence to process, store and display your User Content solely to provide the Service to you (for example, to generate and save your try-on results).
- You must have the right to upload each image. Only upload photos of yourself, or images you own or are permitted to use. Do not upload photos of other people without their consent.
- You are solely responsible for the User Content you upload.
6. Acceptable use
You agree not to use the Service to:
- upload or create content that is unlawful, obscene, hateful, harassing, or infringing;
- generate images of another person without their consent, or in a deceptive, defamatory, or harmful way;
- create sexually explicit, nude, or otherwise inappropriate imagery;
- impersonate any person or misrepresent your identity;
- reverse-engineer, scrape, overload, or disrupt the Service or its infrastructure;
- resell or commercially exploit the Service without our written permission.
We may remove content and suspend or terminate accounts that violate these rules.
7. AI-generated results
Try-on results are generated by artificial intelligence and are visual approximations for preview purposes only. They may not perfectly represent fit, colour, size, texture, or how a garment will actually look on you. Results should not be your sole basis for a purchase decision. See our Disclaimer for details.
8. Intellectual property
The Service, including its software, design, branding, and content (excluding User Content), is owned by TryTheClothes and protected by intellectual-property laws. You may not copy, modify, or distribute any part of the Service without permission. Subject to these terms, you may use and download the try-on results you generate for your personal, non-commercial use.
9. Termination
You may stop using the Service and delete your account at any time from your settings. We may suspend or terminate your access if you breach these terms or use the Service in a way that could harm us or others. Unused credits are non-refundable upon termination for breach.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that results will meet your expectations.
11. Limitation of liability
To the maximum extent permitted by law, TryTheClothes will not be liable for any indirect, incidental, special, or consequential damages, or loss of data or profits, arising from your use of the Service. Our total liability for any claim will not exceed the amount you paid us in the three (3) months before the claim.
12. Governing law
These terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes will be subject to the exclusive jurisdiction of the competent courts in India.
13. Changes to these terms
We may update these terms from time to time. The “Last updated” date reflects the latest version. Continued use of the Service after changes take effect means you accept the revised terms.
